Common Motorcycle Accident Scenarios

  • Cars changing lanes without checking blind spots
  • Drivers failing to yield or turning in front of a rider
  • Dooring accidents
  • Road hazards (potholes, debris)
  • DUI or distracted driving

Injuries Common in Motorcycle Accidents

Traumatic brain injuries (TBI): Head trauma caused by impact, often severe.

Road rash and disfigurement: Skin abrasions from sliding on pavement, ranging from mild to severe.

Broken bones: Arms, legs, ribs, and pelvis are commonly affected.

Spinal cord injuries: Can lead to paralysis or long-term mobility issues.

Internal Injuries: Damage to organs from blunt force trauma, often life-threatening.

How Not Wearing a Helmet Can Impact Your Injury Claim

If you’re injured in a motorcycle crash without a helmet, the insurance company may try to limit your compensation — even if the accident wasn’t your fault. Florida uses a comparative fault system. That means if your actions contributed to your injuries, your payout could be reduced. For example, if you suffer a head injury and weren’t wearing a helmet, the other side might argue you’re partly to blame for the severity of your injuries. If the court agrees, your compensation could be lowered.

Keep in mind, not wearing a helmet doesn’t automatically make you at fault — especially if your injuries don’t involve your head or neck. But it can make your case more challenging. This is why you need a Motorcycle Accident Attorney. Insurance companies often try to shift blame onto the motorcyclist. We protect your rights and ensure you’re treated fairly, helmet or not.

Ride Smart: Safety Tips for Motorcyclists

Whether you’re a new rider or a veteran on the road, protect yourself:

  • Wear a DOT-approved helmet — even if it’s not legally required in Florida for those who are insured and over the age of 21 years old.
  • Carry proof of medical insurance if you ride without a helmet.
  • Use eye protection — it’s required by Florida law.
  • Document everything after an accident, including medical visits and expenses.
  • Speak with a lawyer before talking to any insurance company.
  • Riding offers freedom — but with it comes responsibility. Knowing the law helps protect your health, your rights, and your future.

Florida Motorcycle Helmet Law – What Riders Need to Know

In Florida, motorcycle helmets are generally required for all riders. However, there is an exception:

Riders age 21 or older may legally ride without a helmet — but only if they carry at least $10,000 in medical insurance coverage specifically for injuries resulting from a motorcycle crash.

Regardless of age or insurance coverage, eye protection is always required. This means riders and passengers must wear approved goggles, safety glasses, or a face shield when operating a motorcycle on public roads. Passengers are subject to the same helmet and eye protection laws as drivers.
